Freehold or Leasehold: What You Actually Own
Buyers from the UK know leasehold as a long lease with a ground rent; buyers from continental Europe often have no equivalent and assume everything is ownership. Dubai has both regimes, and the word in the brochure is not always the word on the title deed. What you own decides how easily you sell, whether a bank lends, and whether the property counts for a residence visa.
Freehold
Full ownership of the unit and, as a rule, a share of the land and common areas. You may sell, let, gift, mortgage and bequeath it. Foreigners may hold freehold only in designated areas of Dubai defined by the emirate; outside those areas, ownership is reserved to UAE and GCC nationals. Freehold is the basis for property-linked residence visas, including the Golden Visa for a property of AED 2 million or more at the time of purchase, and it is what banks are most comfortable lending against.
Leasehold
A right to hold and use the property for a long fixed term, measured in decades, granted by the freeholder of the land. At the end of the term the right expires or is renewed on the landowner's conditions. During the term the leaseholder can usually sell and let, subject to the lease, but alterations and some uses require consent. The pool of buyers is smaller, banks are more cautious, and the remaining term drives the price: the shorter it gets, the steeper the discount. Visa programmes are built around ownership, so leasehold eligibility is confirmed per property and per programme rather than assumed.
Usufruct and other rights
Between the two sit rights such as usufruct and musataha, long-term rights to use or build on land. They appear in some areas and structures. Treat them as their own category and read the term and the conditions on renewal before comparing prices with freehold units.
How to tell what you are buying
Not from the listing. Three sources decide it:
- The title deed or Oqood registration, which states the type of right.
- The location, checked against the designated areas where foreigners may own.
- The developer's land title, for off-plan: whether the developer owns the plot or holds it under a long lease, which caps what it can pass to you.
If the listing says "freehold" and the deed says otherwise, the deed wins.
What the difference costs you at exit
Freehold is more liquid: more buyers, more lenders, clearer visa position. Leasehold with a long remaining term sells reasonably in the right district; leasehold with a short remaining term sells slowly and at a discount that grows every year. The time to price that in is at purchase, not at sale.
Ownership by a company
Freehold in designated areas can be held by certain corporate vehicles, but not every structure qualifies, and the rules differ by area and by the type of company. If you plan to buy through a company for tax or succession reasons at home, confirm that the structure is eligible for the specific area before the deposit; re-registering later is a new transaction with new fees.
Mortgages and the type of right
Lenders price the right they take as security. Freehold in a designated area is the standard case and gets the widest choice of banks. Leasehold and usufruct interests are financed by fewer lenders, often for a shorter term, and the remaining term of the lease must comfortably exceed the loan term. If you intend to finance the purchase, get the bank's view on the specific title before you pay a deposit; a unit the bank will not lend against is one you will also struggle to sell to a financed buyer later.
Community rules are the other half of "ownership"
Even in freehold, the community's rules govern short-term letting, pets, alterations to façades and balconies, and use of the unit. Read the community declaration for the building before you plan a holiday-home model or a renovation.

Can leasehold be converted to freehold?
As a rule no. They are separate legal regimes, not stages of the same one.
Does the land belong to me in freehold?
The unit and a proportionate share of the common areas and the plot, in a jointly owned building. In a villa, the plot itself, subject to the community's rules.
Do I need a residence visa to buy freehold?
No. A foreigner can own in designated areas without residency. The property can in turn be the basis for a visa application.
Does leasehold count for the Golden Visa?
The programme is built on property ownership with a registered title. Whether a specific leasehold interest qualifies is confirmed with the DLD at the time of application.
