Residence Visa Through Your Own Company: The Employer's View
Once a UAE company is licensed, it becomes an immigration sponsor. It can sponsor its owners, its staff, and through them their families. Founders usually think about their own visa first; the useful frame is the employer's, because the same file, quota and obligations apply to every person the company brings in, and the obligations continue until each visa is properly cancelled.
The company as sponsor
Before any individual visa, the company needs an immigration file: the Establishment Card and registration with the immigration authority of the zone or, on the mainland, with the federal labour and immigration systems. The file is tied to the licence and to the premises. Its capacity — the visa quota — is set by the zone or authority according to the type of premises: a flexi-desk carries a small allocation, a private office more, a full office an allocation by area. The quota is confirmed for the specific zone before the package is chosen, because expanding it later usually means upgrading the lease.
Steps for each person
- Entry permit applied for by the company as sponsor.
- Entry on the permit, or change of status if the person is already in the country.
- Medical examination at an approved facility.
- Biometrics and Emirates ID application.
- Residence visa issued; the person can now open a bank account, sign a tenancy and enrol children in school.
On the mainland the employee also has a registered labour contract; in free zones the employment relationship runs under the zone's own employment rules. Both routes end in the same residence status.
Family
A resident sponsors spouse and children, and in some cases parents, as a private sponsor rather than through the company. The conditions include a minimum income and suitable housing; the thresholds are set by the authority and revised, so we confirm them at the time of application. Documents proving the relationship — marriage and birth certificates — must be legalised: the UAE is not a party to the Hague Apostille Convention, so certificates go through consular legalisation in the issuing country and the UAE, with sworn translation into Arabic. This is the slowest item in the whole process and is started in parallel with incorporation.
Renewal, absence and cancellation
Residence visas are issued for a fixed term and renewed through the same file, with a fresh medical. A standard visa can lapse if the holder stays outside the UAE beyond a permitted continuous absence; we confirm the current period on the date of issue rather than quote it. Golden Visa holders — for instance on a property worth AED 2 million or more at purchase, issued for 10 years — have more generous absence rules. When an employee leaves, the company cancels the visa; when the company closes, every visa is cancelled before the licence is. A visa left active after the person has gone is a liability for both the person and the sponsor.
What the visa is not
- Not tax residency. Tax residence in the UAE is confirmed separately by the FTA on its own criteria, and residence in your home country ends only under that country's rules
- Not a bank account. Residence and an Emirates ID open the door; source-of-funds review is the same as for anyone
- Not permanent. It depends on the sponsor and the licence remaining valid
Timing and cost drivers
With the licence and a complete file, an individual visa is a matter of weeks. Family visas take as long as legalisation takes. Government fees for the entry permit, medical, Emirates ID and residence stamp are set by the authorities and revised; we confirm them at the time of application. Total cost is driven by the number of visas, their term, and whether the quota requires a larger lease.
Where it goes wrong
- A package chosen for one or two visas when five are needed within the year
- Family documents brought without legalisation
- A director sponsored by the company while managing it from abroad, which undermines both the visa's logic and the company's substance
- Renewals missed; overstay penalties are set by the authority and confirmed on the current date
- Visas left uncancelled at closure, blocking liquidation
Frequently asked questions
Can a shareholder who does not work in the company get a visa?
Yes, in an investor or partner capacity, on conditions that depend on the zone and the shareholding.
Does the visa require living in the UAE full time?
No, but there is a permitted continuous absence, confirmed at issue. Beyond it the visa can lapse.
Can the company sponsor staff before it has premises?
The quota follows the premises; without a lease the file has no capacity.
This is a general framework, not legal advice. UAE law changes, and procedures differ between emirates and free zones. We review each situation individually.
